Court Rulings

Aruba

First came the Aruban ruling on Paulis van der Sloot's action for wrongful arrest. The court found in his favor and apparently made a maximal award of 50,000 Flr, about US$23,000.

The Aruban prosecutor has given media notice they intend to appeal.

[12/3/07] On appeal the award was overturned. While his arrest was without basis, it was not illegal.

New York

Following right on the heels of this decision, exactly as predicted in some quarters, a ruling was handed down the next day or so by Judge Kapnick in the Twitty's New York filing.

The judge refused the case because it has no real nexus with New York, and would therefore be an imposition on New York taxpayers. It was only a question of venue and hadn't yet considered other questions of jurisdiction, which it would also have been likely to fail.

It was NOT a ruling on the merits or facts of the case.

Beth has been on tabloid TV again “crushed” at the failure of this “last chance at justice”. In reality it is hard to see how she and her advisors, and lawyer John Q. Kelly in particular, could ever have expected this case not to fall at this first hurdle.

Moreover in her ruling Judge Kapnick makes it quite clear that the correct venue for the case is Aruba, and rejected Beth's arguments against mounting her case there. Tellingly, the Judge pointed out that Beth had actually been to Aruba since testifying to Kapnick that she couldn't go to the island because of death threats and fear of her life.

In any case there was a “stalking” incident Beth reported in an Aruban hotel carpark that promptly evaporated when she was told the area was well covered with security cameras. This must cast serious doubts on her claims of being significantly threatened while on the island.

What might be “crushing” Beth may be the realisation that her real “only hope” is still where it has always been; with exactly the people she has been busy alienating by attacking and organising her “strikes” and boycott against, in Aruba.

More HMI cyber games

Fresh from the debacle of the Renfro statements, Debbie at Blogs For Natalee (BFN) has been posting a trickle of documents from the case.

This group includes what perports to be the unsigned transcripts of police interviews with Joran and the Kalpoe's.

These documents are archived here below, but you should keep in mind that while they look authentic, they are for the most part unsigned, and their source (BFN) has just been caught out in presenting a fraudluent document, viz the Renfro statement.

These are most likely “police” documents obtained somehow and produced by Jossy and given to Beth and Jug early in the case. Now, having lost the New York case, it is most likely Beth herself who is passing these documants to Debbie at BFN for publication.

On face value these are the documents Beth waved at the cameras on TV when she said she had statements that “proved” sexual assault on Natalee by J2K. It is generally assumed that these are the same documents Jug said would “shock the world” when released.

Instead, the reaction even within the HMI Cult has been more of;

“that's IT???”.
“THOSE are the block-busting details we have been told to expect?”.

Underwhelmed. In fact they contain little we didn't already know or had surmised, only some detail to fill in some cracks. The broad sweep of the case remains unchanged - more damp-squib than block-buster.

I'm only surprised that anyone is surprised. This is exactly what I was expecting.

The only statement that comes close is that he had a plan-he wanted to go to the house to have sex or whatever, but-and they stopped in front of the house, but they did not leave the car. So they didn't go into the house. That's his statement.

And I think that maybe somewhere, somehow Beth saw the statement-it was translated, or she didn't get the statement completely the way it is. But I assure you this is the statement.

On these documents Dompig's statement is true and there is no factual basis for Beth's remarks in bold above, and some indications that they are false. Her construction may be understandable coming as it does from someone in the Republican Bible Belt, but outside that context they represent gross worst-case distortions and magnification of what was actually stated.

They basically give lie to Beth's version of events that night, and deal a serious, if not final, blow to her credibility.

In the first place they confirm what I wrote in the introduction to these pages months ago, and that I thought obvious then; that Beth had ramped up consentual petting to pack rape, consistant with her grossly over-stating all other aspects of the case. Beth's favorite word seems to be “absolutely” and she tends to be absolute about her particular idea of the moment.

These documents, far from damaging Joran, tend to paint a much more normal picture of Natalee and what transpired that night. This may have been more of a shock to the HMI Cult followers who were perhaps expecting some new definitive statements that would provide proof, a confession, of Joran's guilt.

Instead we have a blow-by-blow account that paints a picture of Joran which is a lot less evil and predatory than the faithful had been led to expect; and an image of Natalee that is much more tarnised than they would have expected.

HOWEVER; This material must be read with considerable care and skepticism; these may be versions of events put to the subjects during police interview that they refused to agree to, and were recovered from the trash by Jossy.

They may be total fabrications, and there has been some of that going on. They look authentic, but authentic what? And the object of forgery is to look like the real thing.

Before giving anything they contain any serious weight, carefully consider the dubious route they got here.

To whom it may concern,

The problems for the people of Aruba has gone on long enough.

Natalee is alive, well and safe from Jug. We are staying with my family where Mrs. Holloway cannot find her and she is protected from Jug's sexual advances.

First Natalee and I would like to apologize to the people of Aruba for the troubles that they have endured, we did not believe that Mrs. Holloway and her husband would carry things this far just to get attention for themselves.

We sent a letter to Mrs. Holloway before leaving to explain what we were doing and why.

We believe that she must have received the letter shortly before Natalee was reported as missing since she made such a quick trip to Aruba and started looking for some one to blame right away, to take the responsibility away from Jug.

We are certain that you will understand why Natalee had to do this when Mrs. Holloway and Jug finally admit to truth and allow it to come out to the public.

We are requesting that the reward for Natalee's safe return be given to the people of Aruba when Natalee comes back. But several things will need to take place and change before that happens.

We had this planned for several weeks, but did not believe it would work this well.

It most likely would not have if the boys had not mistakenly claimed that they had picked Natalee up in the morning of her disappearance and Mrs. Holloway had not jumped on too that and held on like a bulldog, sending the police and other search teams off in the wrong direction.

Natalee got into a car with me and the two persons that aided us in getting off Aruba after leaving Carlos and Charlie's. We apparently succeeded in not being seen together before we left, although we were seeing each other almost every day to complete our plans and make final preparations.

Natalee did not want to spoil the trip for the rest of her classmates by leaving any sooner although we were ready earlier.

You can try to locate us if you want. But we are sending these letters through five different friends in different areas in sealed, preaddressed and prepaid packages with instructions for each to send the next package of envelopes to the next person, so only the first person will know where the original was mailed from and no one will know if he/she was the first. The final person will then send the individual letters to Aruba, Holland and the United States.

Since three persons have suffered the most at the hands of Mrs. Holloway and her husband we want to reward the information of Natalee's location to go to these persons.

Joran and the two other boys made a mistake by saying that Natalee was the person that they were with. At the time that they were describing as being with Natalee we were completely off Aruba and on our way home, although their mistaken identity and Mrs. Holoway and her husband's persecution of innocent boys definitely helped as we were held up for eighteen days trying to get out of the country we went to, we were afraid that we would be found at any time.

Except for Mrs. Holloway's persistence to cover the fact that Natalee had left on her own that led the police in the wrong direction the police would have been able to find when, where and how we left Aruba and we would have most likely been located before we got back into the United States, and then to our present location.

We were very glad to see that two of the boys were released and hope that the third boy will be released soon.

If any of the reports of statements alleged to have been made by Joran are true Aruba has a problem with Joran but it does not involve Natalee.

If you will pay attention to Natalee's friends and classmates you might get the message that Joran and the two other boys are not involved in Natalee's disappearance. In every interview that they have taken part in they have all said that they have not seen Natalee and Joran together, only that Natalee left in a car with three persons.

Please advise if these conditions are acceptable to Mrs. Holloway and her husband.

When Natalee is ready to let you know where she is we will send another letter, although is will most likely be after she delivers what she believes to be Jug's baby by rape.

The baby is due in mid December. Natalee is doing well and has a good doctor.

To assure authenticity you will find Natalee's finger prints and a sample of her DNA on some if not all of the twenty letters we sent. We know for certain that the letters to the police labs in the United States and Holland contain these items.

As far as we know the DNA and fingerprint were NOT verified; so this appears to be an example of the lengths some people will go to to generate and fabricate evidence in this case, and to be on your guard that what quacks like a duck may in fact be a turkey.

“Missing” posters

The first poster put up around Aruba by the Fab-7. This was apparently prepared and printed in Alabama prior to their departure. It is hard to understand the wording of this poster if Beth was certain that Natalee had been kidnapped. It looks more like a direct appeal to Natalee to contact Beth, that Natalee is a runaway. “Please call me Hootie, I miss you and love you. Mom is here on Aruba and I really want to talk to you”. This relates to the PvdS letter, above.

Next came the early cash reward posters. The original offer of $100,000 or $200,000 was eventually upped to one-million dollars.
